Default exhaust question

First of all, Happy Thanks Giving to everyone!

I looked around and found the exhaust system I want, the Tanabe Medallion Concept G Blue. I found it on eBay brand new for 622.00 and is designed for 03-05 Evo's. My concern is that there was an issue with the downpipe fitting perfectly on evos depending on what year because of the ACD and non ACD models. If I buy this exhaust system from eBay, even though it's advertised as a unit for 03-05 evos, would it fit perfectly? Refer to the summary below to know exactly what I'm talking about.
My other concern is that this kit appears to be designed for off road use only. If I get a high flow performance cat to replace the test pipe the kit comes with, would that make the kit legal for the streets?

SUMMARY
"B. ACD interference with aftermarket downpipes
Yes it is true that some aftermarket downpipes will not initially fit. This is typically because the manufacturer created the downpipe using either an 03 or 04 model for fitment. Since those model years did not contain the ACD unit, the transfercase was smaller and more compact. But starting with the 05 model year, the transfercase contained the clutch pack which widened the transfercase housing. Most manufacturers have either solved this problem or offer downpipes exclusive for the 05-06 model years. (13)"

I dont think it is the ACD I think it wont fit the MR model because the tranny is bigger due to it being 6spd. That is how almost all the exhausts for the EVO are.

To make it leagal it depends on where you live. I have no cat that is illeagal but I havent got in trouble for it. I have a rejection sticker on my car from it and Have been stopped twice for that but no cops have actually said you have no cat I havent been written up for it either
