One word: Money.
Recalls are only made if they are projected to lose more money through lawsuits and poor publicity than it will cost to perform a recall.
So basically if it hurts or kills a small handful of peiople most companies won't care because it would cost soo much more to perform the recall than to settle a couple of court cases. That's the ugly truth. Of course, there are laws and regulations about this sort of thing, but there are also loopholse; It happens anyway. It's rare but true.

In this case particularly, there is no chance of someone getting injured becasue of a faulty key fob. Therefor the projected cost of recalling and replacing the fobs (millions +) is more than the projected cost of any lawsuits (probably right around $0, who's gonna sue and win for that?) so they don't recall it.
