Anything the mechanic has done besides switching tires? I assume he did a tire rotation only?
it starts out in 2wd and after you start to drive for awhile it switches it self into 4wd and when that happens you cant use the dail to change to either 2wd or 4wd or 4wd lock, however if i stop and switch off the engine it starts back in 2wd and after a moment of driving the cycles starts again

The user manual say that for a 4WD Outlander all 4 tires need to be the same size, type, Brand and wear level. Otherwise this put strain on the various differential and clutch in the transfer case.
I suspect this is your problem and the computer is turning on the rear wheels in order to cool the transfer case.
Your mechanic should have known better.
Finally Mitsubishi recommend you change all 4 tires at the same time even if you destroy just one, unless the other ones have minimal wear or you find one with the same wear level.
Same (marked) size tire from different brands are always different in actual measurements.
