long story......... today my cuz got arrested on three felony warrants and we couldnt figure out why he was arrested. well come to find out a lil 15 year gurl who is all in love with him said that him and her had sex three times and hes 28. shes been tring to get with him for a long time but my cuz is smarter than that and one day she saw him with another gurl and put a letter on his windshield saying UR GONNA PAY BIG TIME. well my younger cuz goes to school with that gurl and shes going around school laughing about the whole thang and that she never had sex with him. how canwe get out of this situation. cuz if he gets convicted hes gonna be facing prision time over some lil hoe who wants his *****

 

I am not a lawyer, however I am thinking of going into law... all of my aunts and uncles are lawyers lol.

Well for this situation shes going to have to go to court and testify against him. I highly doubt she is going to be willing to go thorugh all of the legal bs to convict him... and that is if he is able to be convicted. First I doubt she is going to pay for a lawyer to reprseent her just to get back at someone. Second she is going to have to produce dates and times when said intercourse occured... if your bro didnt do it then hes not going to have a problem putting that **** to rest. Lastly he can sue her for, iam a bit drunk so the specific term escapes me, but its something along the lines of deflamatory of charcter or something to get some punitive damages.

In this case times going to be on your side, just wait for the arrainment i doubt she'll show. If you're really worried tho go and talk to a lawyer, its free and it will give you lots of insight.

She wouldnt have to pay a lawyer to sue him, though, the DA will do all that for her. As it was not only a crime against HER, but also a crime against the state. (statutory rape, lewd and lascivious, etc.) Thats a heavy charge to get, and can carry a hefty prison sentence is hes convicted. Any kind of proof with the exception of DNA evidence (stuff on clothing and whatnot) can usually be considered circumstancial and thusly 'useless' a lot of the time. If all it is turns out to be 'he said, she said' **** (lack of evidence), its likely that the court will even throw it out.

 

thanks guys, well yeah its basiclly that, he said she said, and it is the DA investigating him for the state, he said it was just like a movie, they threw him in a room and started making threats and a whole bunch of bull**** on how there gonna lock him up and not ever letem out. but my cuz stood his ground and toldem you cant lock me up when i didnt do ****. and now he lost his job with the ems until its all over. so really hes guilty until proven inicent

 

That girl needs her *** kicked. I have charges being pressed on me for a fake hate crime cuz of some stupid b**** which can get me 6 months.

I have a rich uncle and a couple years ago some girl was saying he raiped her after a 4th of julyparty. Had court and all that and he came out not guilty. But now alot of people dont like him cause they think he raiped her cuz the stupid b****.

The dudes probably going to be in the newspaper cuz my uncle was.

 

all charges should be filed on her...shes pressing false charges...wich is illegal and she eve admitted to it....IMO i say just stick your size whatever shoe up her *** and beat her with a fish

How good are text messages in court?? well that gurl talks to my cuz whos in the same grade as her and today she text her sayin how bad she felt and how nothing ever happened between them and she did it cuz she was mad at him

 

its evidence and a confession....its gonna point all fingers to her and shell be busted and ur cuz will be clean

 

yup thats definetly something that should hold up as a confession. Hopefully he should be in the clear

 

Its circumstancial. The DA COULD say that she was just trying to save his ***, or that someone else wrote it.

It may be able to be used... it really depends on the judge, DA, etc.
