tranny not coming out of gear

tranny not coming out of gear
my buddy has a 03 eclipse and it will not come out of gear at the tranny the shifter is in netural but when he starts it the tires are spinning while shifter is in netural could this be because of the throw out bearing is put in wrong or the fork on wrong?
