Default Transmission Issue?

I bought this 04 with 55000 miles on it 4 months ago. It drove great until the other day. I had noticed weirdness with the shifting a couple of times prior to this like slow to shift.

Three days ago the temperature got up to 90° here in Richmond. I got on the interstate. I was on the interstate and hit the gas and it wouldn’t accelerate. I made it home. I checked the fluid level in the transmission and it’s over full by quite a bit. It will shift from 1st to 2nd gear if you’re not giving it much gas, but if you try to give it too much accelerator, it won’t shift in the second but as long as you barely accelerate, it will shift you can hear some type of whining or whistling noise while you’re accelerating now too coming from I’m assuming the transmission I’m not sure if this was caused by the fluid being so over full or if something else is going on with it I’ve put about 5000 miles .

Does anyone have any ideas? What could be wrong with this thing thank you.

Hi. welcome. AWD or FWD?
First, mighty low miles!
Are you certain it only has 55K on it?
I would think with that low mileage, it still has the 'factory fill' fluid in it. That being said, 'over' filled is suspect.
> Do you have any history on vehicle-maintenance rcords, etc.? Carfax?
I would do a "drain and fill", a start from scratch if you will.
NOT a 'fush!
Use proper Mitsubishi or Idemitsu fluid. < 100$, if doing it yourself.
Examine old fluid for particles,etc.
Then see if improves with fresh fluid of proper quantity.
Report back,please.

Hi. Yes it’s actually 60000 now. But yes that’s the original mileage. And I’m sure it probably is the original fluid. It’s a little dark but it’s way overfull. You helped me out with my shifter problem not too long ago. I still haven’t fixed that either. I’ve just been parking it with the emergency brake on in neutral.

Anyway, whatever the whistling sort of noise is that it’s making I’m pretty sure is coming from the trans. It never made the noise until it started not wanting to shift. If you give it much gas it won’t shift into second. But if you baby it it shifts normally. It still makes the noise though. It’s probably an inch and a half or two inches over the full line on the stick.

I’m gonna take some out and check it for debris.

I’ll report back.

Thank you.

Hi. AWD-ok.
Q- Are you checking it 'properly'? At idle, on level ground? Shifting through all the gears first?
Sorry ,don;t know your mechanical background/knowledge...
